Terms of Service
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and current.
2. The Services
FuelDrop arranges on-demand fuel delivery to your vehicle at a location you provide. You are responsible for ensuring your vehicle is legally parked, accessible during your selected window, and safe to refuel. We may decline or cancel orders that cannot be completed safely or lawfully.
3. Orders, Pricing, and Payment
- Prices shown at checkout include the cost of fuel, a distance-based delivery fee, and a service fee. Final charges may reflect the actual gallons delivered.
- Fuel is charged at the applicable price per gallon for the quantity delivered. Delivery and service fees are disclosed before you confirm your order.
- Registered users must maintain the required minimum wallet balance to place an order. Order totals are deducted from your wallet upon completion of the delivery.
- Payments, wallet funding, pre-authorizations, and tips are processed through our third-party payment provider.
- Tips are optional, offered after delivery, and paid in full to your fueler.
4. Cancellations
You may cancel an order free of charge before a fueler accepts it. Once a fueler has accepted your order, a cancellation fee may apply, as disclosed at the time of cancellation. Cancellations are not available once fueling is in progress.
5. Your Responsibilities
- Provide accurate vehicle, location, and contact information.
- Ensure the vehicle is accessible, the fuel door is reachable, and no hazards are present.
- Comply with all applicable laws and these Terms when using the Services.
- Keep your account credentials secure and notify us of any unauthorized use.
6. Prohibited Conduct
You agree not to misuse the Services, including by providing false information, interfering with operations, attempting unauthorized access, requesting fuel for unsafe or unlawful purposes, or using the Services in a way that harms FuelDrop, fuelers, or others.
7. Fuelers
Fuel deliveries may be performed by independent providers ("fuelers"). FuelDrop sets standards for service but is not responsible for the independent acts of fuelers beyond what is required by applicable law. Concerns about a delivery should be reported to support promptly.
8. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or available in all areas.
9. Limitation of Liability
To the fullest extent permitted by law, FuelDrop will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid for the order giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless FuelDrop and its affiliates from claims, damages, and expenses arising out of your use of the Services or your violation of these Terms.
11. Changes to the Services and Terms
We may modify the Services or these Terms at any time. We will post the updated Terms with a new "Last updated" date, and your continued use of the Services after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the state in which FuelDrop is organized, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in that jurisdiction, unless otherwise required by applicable law.
